The Third District Court of Appeal of Florida (“Third DCA”) recently withdrew their former opinion in Murphy v. Murphy. Upon reviewing the facts de novo, the Third DCA applied a mixed standard of review. The trial court found that the former wife and her boyfriend were in a “supportive relationship.” The Third DCA held that the trial court’s findings were supported by competent and substantial evidence. Although the live-in boyfriend was not making significant financial contributions to the former wife, he was providing her with valuable, non-economic services. Therefore, the trial court’s order rewarding a reduction in the former wife’s alimony was warranted and supported by the evidence. For more information, click the link below.
